SMP Law – Do You Agree to a Peace Bond…Or Not?

As a lawyer, I have seen peace bonds impact in a number of ways so you must think carefully about your particular situation and consider discussing it with a lawyer.

Peace bonds can be seen differently depending on the judge. For example, a peace bond can be determined that since the person did not go to trial the actual criminal issue was not determined or decided. A peace bond should not be determined an admission of guilt, unfortunately the optics of a peace bond do not sometimes play out that way. There is also the possibility that you may be acquitted of the criminal charge only for the court to state that the standard of proof is higher in the criminal court and as such, the acquittal does not in itself mean the act did not occur, only that it could not be proven more than a benefit of the doubt.

It is important to consider that if you agree to a peace bond that you have your lawyer state on the record that it is not an admission of guilt in criminal or civil, no liability is connected to you, and that you are not admitting to any of the facts.

Whether to enter into a peace bond is not a quick and simple decision. You must consider all the possibilities, particularly if you are also in the middle of a family litigation, and decide which outcome is in your best interests.
