SMP Law – 2023 Year in Review
SMP Law takes a look back at some significant cases in 2023:
Superior Court Level – parental alienation – SMP Law successful at a custody reversal at interim long motion.
Superior Court Level – Cost award of $32,500.00 in favour of client for a successful ½ day summary judgement motion – Order in favour of SMP Law’s client confirming he held 50% beneficiary interest of the disputed Property. The other party was bankrupt and such, the parties included the bankrupt and the bankrupt trustee, in addition to various creditors. Issues involved Resulting trust interest claims, statue of limitations, participant witnesses.
Superior Court Level – Cost award of $16,000.00 in favour of client for a successful one-hour motion – order for the return of a vulnerable person from the UK to Canada, vulnerable person residence ordered to be with SMP Law’s client, PGT instructions provided – equalization payment in favour of client.
Superior Court Level – Security of Cost award of $8,849.77 ordered in this basket motion due to the other party’s noncompliance with previous orders, cost award of $5,201.39.00 in favour of the client, an order barring the other party from participating the proceedings unless he pays the Security of Cost award of $8,849.77, an order that the other party to pay a $100.00 penalty for each and every inappropriate communication sent to either SMP Law or it’s client.
Superior Court Level – Cost award of $7,800.00 in favour of the client for a successful one-hour motion – an order for the return of a vulnerable person from the UK to Canada, an order for preservation order, removal of former Power of Attorney and SMP Law’s client being named Power of Attorney, an order for financial disclosure.
Superior Court Level – Cost award of $7,500.00 in favour of the client for a successful long motion, successfully defended summary judgement motion requesting the implementation of a “kitchen table agreement”.
Superior Court Level – Cost award of $5,000.00 in favour of client for a successful one-hour motion –expert report regarding spousal support issues not allowed due to late production, father ordered to pay outstanding cost order prior to filing further court documents, consequences for failure to pay cost, non compliance with court orders, successful defence of father’s request for an adjournment.
Superior Court Level – Cost award of $2,500.00 plus HST in favour of SMP Law’s client for a settlement conference attendance when the other party was not prepared and failed to comply with previous court orders and the Family Law Rules.
Superior Court Level – parental alienation – SMP Law successful at a custody reversal at interim long motion.
Superior Court Level – SMP Law successfully argued for payment of $190,000 to common law partner, in dispute over ownership of house that client resided in but under title of her common law partner’s parents. Also received lump sum spousal support payment.
Superior Court Level – SMP Law successfully argued for payment of $90,000 to client as lump sum payment for support and equalization in short term marriage with no children.
Superior Court Level – child resided primarily with SMP Law’s client, child support and spousal support in favour of SMP Law’s client, Life insurance, health benefits and section 7 were hotly contested issues and a final order was made in favour of SMP Law’s client.
Superior Court Level – parties started divorce application, during the process, parties elected to renew martial vows and terminated divorce application. Family in intact and very happy.
Superior Court Level – SMP Law successfully argued for the immediate listing for sale of the jointly owned cottage.
