Law firms are typically comprised of sole practitioners who tend to work alone with an administrative person or comprised of multiple practitioners working together along with various clerks and administrative personnel in small to large size firms.
When working with a small to large firm with multiple practitioners, clients have voiced their concerns about the lawyer they hire not being the main practitioner working their file. Clients have also voiced their frustration with the fact that when attending court appearances, the lawyer they hired is not available, and usually a junior lawyer attends who unfortunately does not have a deep understanding of his or her case. This naturally creates confusion and concern for the client about where their file stands and whose legal expertise they are paying for.
If you are thinking about retaining a lawyer from a small to large firm, here are some questions you can ask to ensure your legal needs are met:
1) How many lawyers work in the firm?
2) Will your file stay with one lawyer or be shared by other lawyers in the firm?
3) How are your payments structured? Who are you paying for?
4) If there is multiple lawyers on your file, are you expected to pay both of their hourly rates?
5) Who is the primary lawyer on your file and which lawyer will be your main contact?
6) Which lawyer will attend and address the court on your behalf?
If you decide to work with a law firm that has multiple lawyers and your file will be dealt with by more than one lawyer, do not be afraid to ask to meet with the lawyers that will be working on your file so you can decide if they are someone you work well with and you feel confident in them. Be sure to agree on the manner in which they will handle your file.
